Personal Injury Law: The "Why" and "How" of Settlement Negotiation

If you get injured and have to go to a lawyer for help, you and your lawyer, such as Teresa P Williams PA, will have a few choices. One of those choices is to go to court. Another is to negotiate a settlement. Most lawyers are going to try to get a settlement. 

Why Try to Get a Settlement?

There are a lot of reasons to try to get a settlement instead of going to court. The biggest reason is that going to court can be really expensive. Most personal injury lawyers work on a contingency basis. That means that they are working for a percentage of any settlement. If they have to take your case to court, they are going to risk having that percentage being less profitable. It will cost them money to have to prep witness and do research. 

Another reason that your lawyer is going to try to get a settlement instead of going to court is that going to court carries other risks. One of those risks is that the case may go against you. That means that there is a chance of no monetary award at all. Or, any award made could be much less than a settlement would be. That can be an unnecessary risk.

When Will Settlement Negotiations Start?

Your attorney is going to start talking to the other side about settlements as soon as possible. It can take some time for the negotiations to come to fruition. That means that the sooner that your lawyer starts talking to their lawyer the faster the settlement can happen. There will be a lot of back and forth between the lawyers. Your lawyer will also talk to you so that you know what the other side is offering. You will have the final say as to whether or not the settlement will be accepted. However, your lawyer will be able to tell you if the settlement is a good one or not. Your lawyer will be able to tell you if the offer is the final offer or if there is more room to negotiate. 

When you have been injured, you can end up with a lot of medical costs and other debts. You may need to go to a personal injury attorney to get what you need. If you do have to go to a lawyer they are going to try very hard to get you a settlement instead of having to go to court.
