I created this site to give you the basics of employment law expectations. I hope that the information here helps you to understand what you should and shouldn't do as you're interviewing and hiring your first staff members.

Three Steps To Take After You Inadvertently Cause An Auto Accident

Irene Robertson

You looked away for just a second. Perhaps it was to check an important text message from your kids; maybe you were distracted by an animal on the roadway or a pedestrian crossing against the light. Whatever the reason, your momentary diversion resulted in you rear-ending the car in front of you. What now? If you're at fault in a car accident, here are the steps you need to take immediately.

Retain an Auto Accident Attorney

The consequences of an at-fault accident go far beyond the ticket you're issued by the police. Your insurance rates can skyrocket. You can be held accountable for the injuries of the people in the car you hit. In extreme cases, you may face jail time if you're driving without insurance, and the injuries or damage to the other vehicle is severe.

If you've caused an accident, your first step should be to retain an experienced auto accident attorney. They can ensure that your best interests are taken into account, work to minimize the potential consequences, and do whatever they can to protect you in the event of an at-fault accident.

Prepare a Defense

You'll need to work along with your attorney to prepare an adequate defense for the charges against you. Work your way back from the accident. What distracted you from the road? How did the accident occur?

Photographs from the accident scene can play an integral role in your defense. Did the angle of the sun impair your vision? Were there extenuating factors that helped to cause the wreck? The more doubt you can cast on the plaintiff's case, the better.

Ignore the Nay-Sayers

Conventional wisdom holds that the trailing car is always at fault in a rear-end collision. However, that isn't always the case. There are plenty of reasons the front car can be deemed at fault for the accident, including:

  • Non-functioning brake lights
  • Sudden reversing
  • Sudden stops due to vehicle malfunction (when said-vehicle does not immediately engage the emergency flashers and pull off of the roadway.)

Just because you've rear-ended a car does not mean that you're automatically at fault, despite what well-meaning friends and relatives might have you believe. Apprise your attorney of any mitigating circumstances to ensure that your side of the story is being told.

When you've rear-ended another vehicle, it's second nature to place the blame on yourself. However, when you speak to an attorney, think carefully about how the accident occurred, and look beyond what "everyone" says, it's possible to put the accident behind you without allowing it to affect you for years to come.

These are just a few ways in which an auto accident lawyer can help you.
